  Referring to the precedent set by the United States Supreme Court in Turner vs. Rogers, 564 U.S. 431 (2011), the Massachusetts Supreme Judicial Court (SJC) outlined four essential safeguards for a defendant involved in a contempt proceeding:

  The defendant must be informed that their "ability to pay" is a pivotal consideration in the contempt case.
  A standardized form or equivalent means should be employed to gather pertinent financial information.
The defendant must have an opportunity during the hearing to address inquiries and statements about their financial situation.
  The court must explicitly determine that the defendant possesses the capability to make payments.

Moving on, the SJC examined the federal regulations established to mirror the requirements set forth in the Turner case. These regulations encompass evaluating the defendant's ability to pay, furnishing the court with relevant information about the defendant's financial capacity, and ensuring the defendant is well aware that their ability to pay is the central issue in civil contempt proceedings (45 C.F.R. §303.6(c)(4)).

Lastly, the SJC highlighted that the Department has incorporated these federal guidelines into a policy and procedures memorandum concerning civil contempt. This memorandum emphasizes the Department's responsibility to verify that there is substantial evidence indicating the parent's present ability to pay before assisting with serving a pro se customer's contempt complaint.

The memo also underscores that a parent's existing ability to pay remains the pivotal concern at all stages of the contempt process, from initial screening to court hearings.
